In a further phase of the complete redevelopment of a large commercial site in Dorchester, the Council’s Planning Board members, contrary to their Planning Officer’s recommendation, refused permission for the change of use of a listed building known as The Old School House to residential use on the basis that the minor building alterations would result in harmful overlooking to neighbours and poor living conditions for the future occupiers.
KPPC successfully argued that the Council were being unreasonable and that no harm would result. KPPC also secured a full award of costs against the Council as they could not substantiate their refusal and did not provide any credible evidence to support their case.
